Your Marketing Probably Isn’t Broken. Your Message Is.

Law firm owners ask me all the time: “Rich, why isn’t my marketing working anymore?”

Sometimes they blame Google.

Sometimes they blame Facebook.

Sometimes they blame their agency.

And to be fair, sometimes the vendor really is the problem.

But more often than not, the problem isn’t the advertising.

It’s the message.

One of the biggest mistakes I see law firms make is that they sound exactly like every other law firm in town.

Everyone claims they’re experienced.

Everyone says they’re compassionate.

Everyone promises they’ll fight for you.

Everyone has the same stock photos, the same smiling attorney, and the same predictable copy.

If your message sounds like everyone else’s, why should a prospective client choose you?

The Lesson Dan Kennedy Taught Me

More than 20 years ago, my mentor Dan Kennedy taught me one of the most important concepts in marketing:

Message. Market. Match.

Great marketing happens when those things come together.

Your market is the specific group of people you serve.

Maybe you’re helping families through divorce.

Maybe you’re helping people overwhelmed with debt.

Maybe you’re serving injured workers, immigrants, business owners, or retirees planning their estate.

Each of those people has different fears, different goals, and different motivations.

Your message is everything they hear from your firm.

Your website.

Your ads.

Your videos.

Your newsletters.

Your landing pages.

Your social media.

When your message speaks directly to the people you want to attract, marketing becomes dramatically more effective.

Two Businesses That Understand This Better Than Almost Anyone

A few weeks ago, I attended a mastermind in Las Vegas.

A friend invited me to dinner at a private club inside the Wynn called Zero Bond.

You walk through an unassuming door tucked away in the back of the resort.

Outside, the casino is loud and packed with people.

Inside, it’s quiet. Peaceful. Exclusive.

The first thing I noticed wasn’t the food.

It was how few people were there.

My friend explained that membership is intentionally limited.

There’s a waiting list.

When I asked the manager if that was just clever marketing, he laughed.

The waiting list wasn’t 15,000 people like my friend had told me.

It had already grown to over 31,000 people.

Why?

Because they know exactly who they’re trying to attract.

People who value privacy.

People who value exclusivity.

People willing to pay for a different experience.

The next day I visited another friend in Utah.

He took me to Wasatch Peaks Ranch.

Another incredibly exclusive club.

Only a limited number of homesites exist.

Membership requires an extensive application process.

It can take well over a year.

And they have three simple rules.

No celebrities.

No egos.

No jerks.

Everyone I met had a story about someone who wasn’t accepted because they violated one of those principles.

Again, the business knew exactly who it wanted.

And it wasn’t afraid to tell everyone else they weren’t a fit.

So what does this have to do with your law firm?

Probably more than you think.

Most firms aren’t selling luxury memberships.

But every law firm still needs a message that speaks directly to its ideal client.

The biggest lesson both businesses taught wasn’t luxury.

It was limited supply.

Scarcity creates value.

Exclusivity creates demand.

The same principle works in legal marketing.

The Lesson We Learned Building A Law Firm

Nearly two decades ago I helped build a bankruptcy law firm in Phoenix.

When we started, it was just the attorney and me sitting knee-to-knee in a tiny office.

Revenue was zero.

We had Google listings and a Yellow Pages ad.

That was about it.

Eventually we expanded into television advertising.

Like everyone else, we started with the typical lawyer commercial.

Experienced attorneys.

Trusted advisors.

Call today.

Nothing remarkable.

Results were average.

Eventually we switched to educational television segments where the attorney was interviewed and offered a free bankruptcy guide.

Performance improved dramatically.

Instead of one lead per segment, we started generating eight.

Then I attended another Dan Kennedy event.

He made one statement that completely changed our marketing: “An advertisement without a deadline isn’t direct response.”

So we made one simple change.

Instead of saying,

“Call for your free book.”

We said,

“We only have 27 copies left. The next 27 callers can have one for free.”

Same television station. Same host. Same attorney. Same interview.

One small change.

The phones exploded.

Our staff thought something had broken.

Instead of eight leads… We generated eighty.

Nothing changed except the message. The market was the same. The media was the same. The offer was the same.

The only difference was scarcity.

Limited supply created urgency. Urgency created action.

Three Questions Every Law Firm Should Ask

If you’re looking for more qualified leads, start here.

  1. What can you give away?A guide. A checklist. A planning resource. A workshop. Even a consultation. If you don’t have one yet, create one.

Today, with AI and modern tools, there’s almost no excuse not to.

  2. How can you create legitimate scarcity?Maybe it’s only available this month.Maybe only the first group receives it.

    Maybe appointments are limited.

Maybe enrollment closes on a specific date.

People respond when they believe they might miss the opportunity.

  3. Are you testing? The best marketers never assume. They test.

    Different headlines, offers, audiences, deadlines.

    Every improvement compounds over time.

Stop Copying Everyone Else

Too many firms simply imitate whatever every other lawyer in town is doing.

That’s exactly why they blend in.

The firms that dominate their markets don’t have better luck.

They have better messaging.

When your message speaks directly to the right market and gives people a compelling reason to act now, you create momentum that advertising alone can never produce.

Before I left that Phoenix law firm, we’d given away more than 27,000 copies of our free book.

That wasn’t an accident.

It was the result of matching the right message to the right market and continuously testing until we found what worked.

Marketing isn’t about shouting louder.

It’s about saying the right thing to the right people at the right time.

Get that right, and everything else becomes much easier.
